A BILL TO BE ENTITLED
AN ACT

 

To amend Article 11 of Chapter 6 of Title 40 of the Official Code of Georgia Annotated, relating to miscellaneous provisions of the uniform rules of the road, so as to provide for a fine for leaving a child unattended in a passenger car; to provide for related matters; to repeal conflicting laws; and for other purposes.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:

 

SECTION 1.

Article 11 of Chapter 6 of Title 40 of the Official Code of Georgia Annotated, relating to miscellaneous provisions of the uniform rules of the road, is amended by inserting a new Code Section 40-6-256 to read as follows:
"40-6-256.
(a) A person responsible for a child six years of age or younger shall not leave that child in a passenger car, as defined in Code Section 40-1-1, without supervision in the passenger car by a person at least 14 years of age if the conditions present a risk to the child´s health or safety.
(b) Any person who violates subsection (a) of this Code section shall be punished only by a fine of not more than $15.00; but, the provisions of Chapter 11 of Title 17 and any other provision of law to the contrary notwithstanding, the costs of such prosecution shall not be taxed nor shall any additional penalty, fee, or surcharge to a fine for such offense be assessed against a person for conviction thereof. Such fine may be reduced to an amount of not more than $5.00 upon a finding by the court of financial hardship on the part of the person charged with a violation of this Code section."

SECTION 2.

All laws and parts of laws in conflict with this Act are repealed.
